Please read these Terms & Conditions (“Terms”) carefully before using RooBazaar (the “Platform,” “we,” “us,” or “our”), accessible at [roobazaar.com]. By creating an account, browsing, or placing an order on RooBazaar, you (“you,” “customer,” or “user”) agree to be bound by these Terms. If you do not agree, please do not use the Platform.
These Terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka, including but not limited to the Consumer Affairs Authority Act No. 9 of 2003, the Electronic Transactions Act No. 19 of 2006, the Personal Data Protection Act No. 9 of 2022, and the Customs Ordinance.
1. About RooBazaar
RooBazaar is an online marketplace that connects independent vendors (“Vendors,” “Sellers”) with customers in Sri Lanka. Some products listed are supplied and fulfilled directly by RooBazaar (including items imported in bulk from overseas suppliers), while others are listed and fulfilled by independent third-party Vendors operating their own stores on our Platform.
RooBazaar acts as an intermediary/marketplace facilitator for Vendor-fulfilled listings. Where a product is sold by a Vendor, the contract of sale is between you and that Vendor, and RooBazaar’s role is limited to facilitating the listing, payment, and (where applicable) logistics.
2. Eligibility
You must be at least 18 years of age, or the age of majority in your jurisdiction, and have the legal capacity to enter into a binding contract to use this Platform. By placing an order, you confirm that you meet this requirement.
3. Account Registration
You may be required to create an account to place an order. You agree to provide accurate, current, and complete information, and to keep your login credentials confidential. You are responsible for all activity under your account. Notify us immediately of any unauthorized use.
4. Products, Pricing & Availability
- All prices are listed in Sri Lankan Rupees (LKR) unless otherwise stated, and are inclusive of applicable local taxes unless stated otherwise.
- Product descriptions and images are provided by RooBazaar or the relevant Vendor and are intended to be accurate, but minor variations (colour, packaging, exact specifications) may occur, particularly for imported goods.
- Prices, promotions, and product availability may change without notice. We reserve the right to correct pricing errors, including after an order has been placed, and will notify you before processing if this occurs.
- We do not guarantee that any product will be in stock at the time of your order.
5. Orders & Contract Formation
Placing an order constitutes an offer to purchase. A contract of sale is only formed once we (or the relevant Vendor) confirm and accept your order, typically via an order confirmation email or notification. We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, pricing errors, or stock unavailability, in which case any payment made will be refunded.
6. Payment
We accept payment via the methods displayed at checkout (including online payment gateways such as PayHere, and any other methods we may introduce). By submitting payment, you confirm that the payment details provided are valid and that you are authorized to use the selected payment method. We do not store your full card details; payments are processed through PCI-DSS compliant third-party payment processors.
7. Imported Goods, Customs Duty & VAT
Many products on RooBazaar are imported from overseas suppliers, including China, as part of our regular consolidated import shipments.
- Where products are sold as already-imported, cleared stock held in our Sri Lanka warehouse, the listed price is final and inclusive of import costs; no further customs charges apply to you.
- Where indicated, any estimated customs duty, VAT, PAL, or CESS figures shown on the product or cart page are provided for your general information only. These are approximate estimates and are not charges collected by RooBazaar. Actual duty, if applicable to your specific order, is determined solely by Sri Lanka Customs at the time of import, based on the applicable HS Code, customs valuation, prevailing exchange rate, and current regulations, and may differ from any estimate shown.
- RooBazaar is not liable for delays, additional charges, or seizure of goods arising from actions of Sri Lanka Customs or any other regulatory authority, provided we have acted in good faith and in compliance with applicable import regulations.
8. Shipping & Delivery
- Estimated delivery timeframes shown at checkout are approximate and not guaranteed. Imported items may be subject to longer timeframes due to consolidated shipping schedules, customs clearance, or courier delays.
- Risk in the goods passes to you upon delivery to the address provided. Please inspect your order upon receipt and report any issues per our [Return & Refund Policy].
- We are not liable for delays caused by incorrect address information provided by you, courier delays, customs processing, force majeure events, or other circumstances beyond our reasonable control.
9. Vendor Marketplace Terms
If you purchase from a third-party Vendor on RooBazaar:
- The Vendor is solely responsible for the accuracy of their product listings, the quality and legality of the goods sold, and compliance with all applicable consumer protection and product safety laws.
- RooBazaar reserves the right to remove any Vendor or listing that violates these Terms, applicable law, or our Vendor agreement, but does not pre-verify every listing and makes no independent warranty regarding Vendor-supplied goods beyond what is stated in this policy or required by law.
- Complaints regarding Vendor-fulfilled orders should first be raised with RooBazaar support, who will facilitate resolution with the relevant Vendor.
10. Cancellations, Returns & Refunds
Please refer to our separate [Return & Refund Policy], which forms part of these Terms.
11. Prohibited Products & Conduct
RooBazaar and its Vendors will not list, sell, or facilitate the import of goods that are illegal, counterfeit, or restricted under Sri Lankan law, including but not limited to items prohibited under the Import and Export (Control) Act No. 1 of 1969, controlled substances, weapons, and items infringing third-party intellectual property rights. You agree not to use the Platform for any unlawful purpose, to submit false reviews, or to attempt to interfere with the Platform’s security or operation.
12. Intellectual Property
All content on the Platform, including logos, text, graphics, and software (excluding Vendor-submitted product content and images, which remain the property of the respective Vendor or their suppliers), is the property of RooBazaar / Doctor On Care (Pvt) Ltd and may not be reproduced without permission.
13. Limitation of Liability
To the maximum extent permitted by Sri Lankan law, RooBazaar shall not be liable for any indirect, incidental, or consequential loss arising from your use of the Platform or purchase of any product, except where such liability cannot be excluded by law (including under the Consumer Affairs Authority Act No. 9 of 2003). Nothing in these Terms limits any statutory rights you may have as a consumer under Sri Lankan law.
14. Indemnity
You agree to indemnify and hold RooBazaar harmless from any claims, losses, or damages arising from your misuse of the Platform or breach of these Terms.
15. Force Majeure
RooBazaar shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, strikes, port closures, customs delays, or government action.
16. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Sri Lanka. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Sri Lanka. Consumers may also raise complaints with the Consumer Affairs Authority of Sri Lanka.
17. Amendments
We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. Material changes will be indicated by an updated “Last updated” date above.
18. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.
